legalese. When Charles A. Beardsley, then president of the American Bar Association, kidded his fellow lawyers with the fa- mous words “Beware of and eschew pompous prolixity,” he was campaigning against what philosopher Jeremy Bentham called “literary garbage,” legal talk that has nothing to do with commu- nication. “Legalese” consists principally of long-windedness, stilted phrases such as “Know all men by these presents,” redun- dancies including “separate and apart” or “aid and abet,” such quaintisms as “herewith and heretofore,” and foreign-language phrases that could easily be translated into plain English: e.g., ca- veat emptor (“let the buyer beware”) or amicus curiae (“friend of the court”). Despite the efforts of Beardsley and many others, the situation has not improved much over the last millennium. Some, like Sir Thomas More, have believed that it never will. More, a lawyer himself, explained that lawyers are “people whose profession is to disguise matters.”
